Terms and Conditions of Sale:

All sales transactions are subject to these terms and conditions unless otherwise stated in writing.

Quotations are good for 30 days unless otherwise indicated in writing. Pricing shown on this site is subject to change without notice.

Prices do not include installation or calibration on-site. Accredited calibration services are not included in the pricing shown and are available for an additional amount and need to be arranged with Cech Corporation prior to shipment.

If the unit purchased is to be used in a legal for trade application, the laws of the State in which the equipment will be used apply, especially in regards to being “placed in service” with that State. It is the responsibility of the customer to know the applicable rules and regulations for the State the equipment will be used.

Applicable sales, goods and services, use, excise or similar taxes are not included in pricing. Any such tax that Cech Corporation may be required to pay or collect will be added to each invoice and paid by the customer unless they have provided a valid tax certificate, which is acceptable by the applicable taxing authorities prior to shipment. Should this certificate be found to be invalid, customer is responsible for the tax amount plus any penalties that may be incurred.

Unless previous arrangements have been made with Cech Corporation for credit line / billing terms, equipment purchased will be paid for via credit card, PayPal, or pre-paid with a cashiers check. Type of credit cards accepted, use of PayPal or similar services, and/or acceptance of pre-payment for equipment subject to change without notice.

Delivery is based upon availability at the manufacturing facility. Title passes to the customer upon delivery to a carrier. Cech Corporation has the right to make and bill for partial shipments. Customer is responsible to pay for such partial shipments as per the terms above.

Shipments are FOB shipping point. Unless a “freight collect” method is chosen by the customer, applicable shipping and handling fees will be added to the final invoice.

Purchases are subject to the applicable laws of the United States, dependant upon the location of delivery of products / services. Cech Corporation does not guarantee fitness for use of any product sold in regards to conformance with any federal, state or local laws, ordinances, regulations, codes or standards except as may be provided for by the individual equipment manufacturer in writing. Any necessary permits or inspection fees are not included in the prices of the products unless otherwise specified in writing.

In no event shall Cech Corporation be liable for any type of special consequential, indirect, incidental or penal damages, whether such damages arise out of or are a result of breach of contract, warranty, tort (including negligence), strict liability or otherwise. Additionally Cech Corporation shall not be liable for any loss, claim, expense or damage caused by, contributed to or arising out of the acts or omissions of the customer or third parties, whether negligent or otherwise. Such damages shall include but not be limited to a loss of profits or revenues, loss of the use of the equipment or associated equipment, cost of substitute equipment, facilities, down time costs, increased construction costs or claims by contractors or clientele of the customer for such damages. Customer agrees that in the event of a transfer, assignment, or lease of the equipment sold hereunder customer shall secure for Cech Corporation the same protections described in this paragraph. In no event shall the liability of Cech Corporation for any cause of action whatsoever exceed the cost of the item giving rise to the claim, whether based in contract, warranty, indemnity, or tort (including negligence).
